A rear-end collision at a traffic light in east Lexington resulted in the death of one driver.

Lex18 reports that this crash happened on New Castle Road at around 11:45PM. Allegedly, the driver of an SUV struck the back of a vehicle waiting at a red traffic light.

Tragically, the force of this collision was so strong that the driver of the stopped vehicle was killed. First-responders say the driver and passenger in the SUV are expected survive their injuries.

Police believe speed was a factor, and the driver of the SUV was charged with driving under the influence and possession of a controlled substance.

What is Wrongful Death?

After a terrible crash like this, loved ones may file a wrongful death claim. This is generally the last thing on people’s minds. Unfortunately, it’s the first thing on an insurer’s mind. While people are devastated and focused on grieving, an insurer may be looking at ways to reduce their liability or even hoping that you never call them to begin with.

A wrongful death claim is filed on behalf of the deceased by family members when a death was the direct result of someone’s or some entity’s negligent actions, or failure to take action.

DUI & Speeding: Major Causes Of Traffic Fatalities

Although the USA has made great strides in traffic safety throughout the 20th century, there’s still a great deal of work to be done. The Centers for Disease Control & Prevention (CDC) has found that at least 90 Americans die in car collisions every day. This is the highest rate of traffic fatalities for any industrialized nation.

The two most common reasons for traffic fatalities in the USA include speeding and DUI. At least one in three traffic fatalities in the USA is related to alcohol-induced DUI. CDC data also suggests about one in three crash deaths involves speeding.
