DUI Laws In Kentucky

In Kentucky, you can be charged with DUI if your blood alcohol content (BAC) measures 0.08 percent or higher. Anyone younger than 21-years-old, however, could be arrested if they have a BAC of 0.02 percent or higher.

A few of the penalties you’ll face on a first DUI offense include a 30 to 120-day license suspension and a mandatory 90-day alcohol abuse treatment class. Second offenders will have to take a one-year alcohol treatment class and will face a suspended license for between 12 to 18 months. The license suspensions increase to between 24 to 36 months and 60 months for the third and fourth DUI offenses, respectively.

It’s important to remember that DUI doesn’t just include alcoholic beverages. If you’ve used any substance that dulls your senses, including marijuana, non-prescription drugs, or prescription medication, you could be charged with DUI. Please check with your doctor before taking any drugs that might impair your senses while driving.
