Snowy, icy conditions have wreaked havoc on Louisville roads over the past few weeks, and while conditions are mostly problematic for drivers, it’s also proven to be difficult for people moving on foot as well. However, as a recent story from WHAS 11 shows, these conditions combined for a serious accident that left a Grayson County man severely injured. According to the Grayson County Sheriff’s Office (GCSO), a 58-year-old man was struck by a car as he was standing just outside his driveway on Falls of Rough Road on Thursday, January 16, 2025. GCSO deputies say the man, along with two others, was trying to guide a truck and camper up his icy driveway. Witnesses said the man was wearing a reflective safety vest and was waving a flashlight at oncoming traffic, but a driver struck him from behind, sending him rolling over the car and breaking through the back windshield before being thrown back onto the roadway. The man was taken to a local state park and airlifted to University of Louisville Hospital in serious condition. The driver, a 36-year-old man, was not charged. However, GCSO says that a toxicology report is still pending. Kaufman & Stigger, PLLC | Grayson County Man Sent to U of L Hospital After Being Hit by Car - 1

Do You Still Have Legal Options If You’re Struck By a Car While You’re Standing in the Road?

Obviously, you never want to be in a situation where you’re standing in the road while traffic is moving. That said, the story above shows that even with taking all the necessary precautions–wearing a reflective vest and waving a flashlight–accidents can still happen. And while it could be argued that a driver had no choice if you’re standing in the road at the time, the reality is that you can still file an injury claim in this situation because:
  • They’re still responsible for staying alert and driving safely to avoid accidents.
At the same time, though, your actions can impact your claim. Kentucky follows a “comparative negligence” rule, meaning if you share some fault, your potential damages are going to be reduced by your percentage of fault. So, even if you were taking precautions, being on the road could be argued as contributing to the accident. Even if you’re partially at fault, you can still file a claim to recover damages. Serious injuries like the ones from this accident can have long-term consequences, so reaching out to our team of experienced Louisville pedestrian accident lawyers at Kaufman & Stigger, PLLC can help protect your rights and make sure you get the support you need.
