Every car accident that happens in Kentucky is going to cause some level of injury. If you’re involved in one, it’s hopefully relatively minor. But the worst accidents are fatal, and it’s often head-on collisions that are especially dangerous. This is what happened in a recent crash in Gallatin County, according to a story from Fox 56.

On Friday, February 28, 2025, an 18-year-old man was killed and a 20-year-old man had to be LifeFlighted to a hospital with serious injuries after a head-on collision at the intersection of Kentucky Highway 1039 and Knox Lillard Road. Kentucky State Police (KSP) officers responded to the scene around 8:15 p.m. and found the two vehicles. The 18-year-old was driving a 2007 minivan when it’s believed that he crossed the centerline and collided head-on with the 20-year-old man driving his pickup truck.

Investigators were unable to determine why the 18-year-old man veered into the other lane, but he was pronounced dead at the scene. The 20-year-old man had to be flown out by helicopter to treat his injuries. His condition is currently unknown.

What Options Do I Have After a Fatal Car Accident in Kentucky?

When there’s a head-on collision, it’s obviously pretty scary. And while fault is generally pretty easy to figure out, you still have to deal with the fallout. This is only increased if injuries are fatal, which means you (or your surviving family) are going to have to be the one that has to go through the legal process.

But the legal process is slightly different in a fatal car accident. Rather than a standard injury claim, a “wrongful death” claim is what needs to be filed. Further, Kentucky law says that:

  • Only the personal representative (executor) of the deceased person’s estate can file the claim, as appointed by a will or probate court.

Once this is fleshed out, though, the process is similar to a regular car accident case. The claim can be filed either through insurance or via a lawsuit. However, the damages that are available are focused on the losses of you or your surviving family members, including:

  • Medical and funeral expenses
  • Loss of companionship and emotional distress
  • Financial support the deceased would have provided
  • Lost salary, benefits, and future earnings
  • Punitive damages to deter wrongdoing

In Kentucky, the statute of limitations is one year from the date of death. Missing this deadline may prevent the family from being able to file a claim and recover these damages. So, when  you consider how important this is, you should talk to our team of experienced Kentucky fatal car accident lawyers at Kaufman & Stigger, PLLC.
