No matter how careful you are, you’re always vulnerable to an accident on Interstate 64, one of the Louisville area’s busiest roads. What’s worse, there’s often extra things to worry about, like construction and larger vehicles. According to a story from WDRB, all of this combined for a serious accident that left a 25-year-old man dead on Monday, August 12, 2024.
Louisville Metro Police Department officers responded to the scene of a five-vehicle accident on I-64 in eastern Jefferson County around 4:30 p.m. Investigators say a 25-year-old man was pronounced dead at the scene due to blunt force trauma. He was driving a pickup truck in the center lane of westbound I-64 that was heavily congested due to construction. Traffic had slowed when a semi-truck rear-ended the pickup truck, causing a chain reaction that involved three other vehicles.
Two adults in the other vehicles were transported to the University of Louisville Hospital with injuries. The semi-truck driver was uninjured.
Is a Truck Driver Liable For Injuries in an Accident?
Semi-trucks aren’t an uncommon sight in Louisville, particularly along I-64. But as the story above shows, these vehicles are at the center of many serious accidents. When you’re involved in one, one of the first things you need to figure out is who’s liable (or legally responsible) for your injuries.
It still rests on negligence, but in a typical truck accident, there’s actually a few different parties that could be involved, including:
- The driver of the truck may be directly liable for the accident, if they were speeding, under the influence, or something similar.
- The company that the driver works for can share liability for the driver’s actions and the truck’s condition.
- If the truck or its parts malfunctioned or didn’t work, and it played a role in the accident, the manufacturer might be liable.
- The person who loaded the cargo may be liable if their work led to the accident.
- If maintenance issues contributed to the accident, those responsible for upkeep may be liable.
- The driver of another vehicle involved in the accident may also share liability.
- If road conditions or design contributed to the accident, local government or contractors might be at fault.
