Generally speaking, you’re more likely to be involved in a hit-and-run accident as a pedestrian in Louisville if the conditions are right. They usually happen late at night, when visibility is low and the driver thinks nobody saw what happened. Likewise, if you’re a younger person that might not see the danger in crossing a given street or walking along a quiet road, you could easily find yourself injured—or worse, as a story from WDRB highlights.

Around 11:00 p.m. on Thursday, April 16, 2026, Louisville Metro Police Department deputies responded to a call regarding an injured pedestrian at the intersection of Vaughn Mill Road and Briscoe Lane. When they arrived on the scene, they found a young male pedestrian that had been struck by a car. The impact had sent him off the roadway and into a nearby ditch. He was pronounced dead at the scene by EMS.

After an initial investigation, LMPD says that they believe the pedestrian was walking along the shoulder of the northbound lane of Vaughn Mill Road when he was struck from behind by a vehicle. The driver of the vehicle did not stop to give aid to the pedestrian, and LMPD went on to say that the section of the road where the accident took place was unlit and dark. LMPD’s Traffic Unit is investigating the collision, and are asking the public for help with any information they may have.

What Are My Legal Options If My Loved One is Killed in a Hit-and-Run Pedestrian Accident?

Losing someone you love in a hit-and-run is overwhelming. There’s the shock of what happened, the frustration of not having immediate answers, and the weight of figuring out what to do next. And it’s all intensified if your loved one is younger.

But the fact remains that you and your family have legal options—namely a wrongful death claim. This type of claim is different from a standard injury case. Instead of being filed by the injured person, it’s filed by:

  • The personal representative of the estate.

A lot of people in this situation don’t have a will (and even less prepared if your loved one is a child). So, a probate court typically appoints a close family member as the personal representative, and that allows them to move forward with a claim.

The issue is finding the driver that’s responsible. If that doesn’t happen, you’ll have to rely solely on any insurance policies that cover fatal accidents. Outside of that, everything rests on finding the driver.

When that happens, the best path forward is typically a lawsuit. Unlike a regular injury lawsuit, a wrongful death lawsuit focuses on different “damages” like:

  • Medical care and funeral expenses
  • Loss of companionship and the relationship you shared
  • Emotional pain and grief experienced by surviving family members
  • The guidance and support your loved one would have provided
  • Lost income, benefits, and future financial contributions
  • In some cases, additional damages meant to hold the driver accountable

Timing also matters here. Every state has a deadline—called the statute of limitations—for filing a wrongful death claim. In Kentucky, you only have one year to file. In hit-and-run cases, that timeline can become especially important if there’s an ongoing investigation. That’s why it’s in your family’s best interest to have the right guidance from the start.
