There’s no situation that’s more difficult than your child getting hurt in an accident. It’s a helpless feeling, whether it’s a minor accident or something worse. And unfortunately, accidents can even happen at places that are designed for their safety. Like bus stops, for example.
According to a story from WKYT and KOLO, a Fayette County Public Schools student was seriously injured on Tuesday, October 13, 2026 when a car struck them at a bus stop on Briar Hill Road in Lexington. Lexington Police Department (LPD) deputies were called to the scene of the accident around 7:25 a.m. Once there, they discovered that the student was struck while they were on their way to the bus stop. An investigation later confirmed that the school bus did not have its stop arm extended, which they believe played a part in the accident. They have yet to file criminal charges against the driver that struck the child, which suffered life-threatening injuries in the accident.
The story also noted that this is the second time a child has been injured at a bus stop this school year, despite the passage of a bill that increased the penalties for not stopping for a school bus.

Who’s Responsible For an Accident That Injures My Child at a Bus Stop?
As the above story shows, children are unfortunately very vulnerable to accidents at bus stops. This is especially true in situations where drivers try to pass or get around the bus. But crucially, it’s even more likely when the bus doesn’t have its stop arm extended. And that brings you to the real question: who’s responsible when your child is injured at a bus stop.
Also unfortunate is the fact that it’s not always easy to answer. Generally speaking, though, it legally comes down to whoever was negligent and caused the accident to begin with. And that has a lot to do with the specifics. That usually involves:
- A driver that was being careless or reckless in trying to get around the bus.
- The school district, bus driver, or the government if they didn’t follow the right protocols at the bus stop.
- The company that made the bus or its parts if something prevented it from working correctly.
Of course, everything comes back to what actually happened to your child. And because you likely weren’t there, it can be hard to get good information or even know where to turn for answers. That’s where our Lexington school bus accident team at Kaufman & Stigger can step in and guide you.
